We all know that. We discover a great picture on social media and want to share it with our friends. Thas is not a problem in technically as for example Facebook, Twitter and LinkedIn offer this possibility. However, the situation is different for Instagram: the app itself does not offer a “share” button. Now, if you want to share Instagram pictures, you’ll need to use a third-party app. BUT: there is a legal sticking point here, which I would like to inform about.
I would point out that this is not legal advice and that this blog article is merely the result of my own research and that there is no claim to completeness or accuracy. For legal advice please, contact your lawyer.
Sharing images from Instagram using a third-party app
Apps, such as Repost download the corresponding image to your phone or tablet so that you can publish it to your account with a credit to the author. Now one should think that the attribution took into account all legal aspects. After all, the person who posted the picture got mentioned.
But it’s not that simple!
In this case, unlike the sharing feature on other networks, the download and re-posting will republish. And this may only be done if you own the rights to the image or if you have the permission of the creator.
How can you legally share Instagram posts?
You should contact the photographer and ask for permission to repost. It can be assumed that he / she agrees to a new publication with the mention of his name or acounts, since this naturally also increases his own reach. Of course, this cannot be assumed.

It is sufficient to contact the photographer via direct message. Tell him that you would like to share the specific image in your own Instagram feed. Add a screenshot to make clear which photo you would like to repost. Tell the photographer if you just want to share the image within Instagram, or if it’s also automatically posted to Facebook.
